Series Description
Original papers filed in proceedings about roads, bridges, public
landings, and ferries as handled by the circuit court and its
predecessor, the county court, and as filed by the levy court.
Documents include petitions, objections, court orders,
commissioners returns, surveys and plats, and damage awards to
landowners. Cases are arranged chronologically by ending date. In
Talbot County the county court handled petitions for private
roads and after 1818 those involving public roads. Under Acts of
1797, Ch. 63, the Talbot County Levy Court heard petitions to
open or alter public roads and after reaching decisions filed the
papers with the county court for recording purposes. A statewide
law passed in 1819 (Acts of 1818, Ch. 89) moved this function to
the county court. Other portions of the road records stemmed from
special legislative acts for specific roads or bridges, that
directed documents to be filed with the county court. All
responsibility for roads was transferred to the county
commissioners by Ch. 220, Acts of 1853.
Most files were recorded in (Road Record) in series C1908 and
C1909. The unrecorded papers, about 20% of the folders, will be
scanned for the plats project. Two of those files involved
applications, appointments, and salaries of ferry keepers,
1857-1858. Access available in electronic form derived from the
records themselves. The two series are housed in 60 folders, each
containing an average of 20 pages of text and plats.
