Series Description
Proceedings in regard to roads, bridges, public landings, and
ferries as handled by the circuit court and its predecessor, the
county court, and as filed by the levy court. Until the
establishment of the levy court in 1795 the justices of the
county court functioned as the county government and handled all
matters concerning the establishment and maintenance of public
roads. The earliest volumes, covering 1701-1787, pertain to this
activity and contain an annual descriptive list of roads and the
appointment of an overseer for each one. The later records,
dating from 1798, concern proceedings of the county court and
levy court to open, alter, or close public roads and to lay out
private ones. Documents include petitions, objections, court
orders, commissioners returns, surveys and plats, and damage
awards to landowners. Entries are arranged chronologically by
recording date. In Talbot County the county court handled
petitions for private roads and after 1818 those involving public
roads. Under Ch. 63, Acts of 1797, the Talbot County Levy Court
heard petitions to open or alter public roads and after reaching
decisions filed the papers with the county court for recording
purposes. A statewide law passed in 1819 (Ch. 89, Acts of 1818)
moved this function to the county court. Other portions of the
road records stemmed from special legislative acts for specific
roads or bridges, that directed documents to be filed with the
county court. All responsibility for roads was transferred to the
county commissioners by Ch. 220, Acts of 1853. Access available
